DR Congo : The Constitutional Court Celebrates 10 Years of Upholding the Rule of Law

Created in 2015, the Constitutional Court of the DRC (Democratic Republic of Congo) celebrates its 10th anniversary this year. A key pillar of democracy and the rule of law, this institution has played a decisive role in protecting the fundamental rights of citizens and maintaining the balance of power within the country.

Since its establishment, the Constitutional Court has asserted itself as the guarantor of the conformity of laws with the Constitution, thus contributing to the evolution of the Congolese legal and political landscape. Faced with numerous political, economic, and social challenges, its work remains crucial to ensuring stable democratic governance that respects constitutional principles.

The President of the High Court, Dieudonné Kamuleta Badibanga, emphasizes the importance of this institution in resolving electoral disputes, protecting constitutional rights, and consolidating democratic gains in the DRC.

Over the past decade, the High Court has issued rulings and judgments that have shaped the country's legal framework. Its work has, in particular, enabled it to arbitrate electoral disputes, ensure the protection of fundamental freedoms, and rule on sensitive issues affecting the balance of powers.

On this anniversary, the institution wishes not only to recognize the progress made in the protection of constitutional rights and justice, but also to assess the obstacles encountered to improve its effectiveness. The mobilization of citizens, political actors, and civil society is also essential to initiate a collective reflection on the future of constitutional justice in the DRC.

This celebration is not limited to a retrospective assessment; it is also an opportunity for the Constitutional Court to reaffirm its commitment to democratic values ​​and human rights, which are essential to the country's development.

Through this historic milestone, the Court commits to pursuing its mission with rigor and impartiality, thus ensuring a strengthened rule of law in the DRC.

As a reminder, the Constitutional Court is one of the three courts that arose from the ashes of the Supreme Court of Justice (CSJ). These are the Court of Cassation, which is a judicial division; the Council of State, an administrative division; and the Constitutional Court, which deals with the legislative division.

Finally, it should be noted that the Constitutional Court of the Democratic Republic of Congo has been chosen to host the 8th Congress of the CJCA, which will be held in Kinshasa in the last quarter of 2026.
