Senegal: Publication of the winning book of the “CJCA Thesis Prize” competition
Although justice in general and constitutional justice in particular are often criticized, rightly or wrongly, they remain a favorite subject among researchers. This is why this work on “The legal protection of the constitutional order in Senegal” by Cheikh Mbacke Ndiaye comes at the right time. His scientific approach focuses on the collection and interpretation of court decisions and opinions that ensure the protection of the constitutional order in Senegal.
Unlike those who rely on intuitions or prejudices resulting from imagination and external perception, he analyzes decisions with value neutrality, highlighting their advantages and highlighting their disadvantages. To this end, he clearly identifies the challenges faced by judges and the constraints arising from the texts and the status of judges. She identified prospects for improvement, although not exhaustive, with the aim of promoting an increasingly effective constitutional justice system, and put forward proposals for procedural reform in order to better guarantee fundamental rights and the regular functioning of institutions.
Ultimately, Cheikh Mbacké Ndiaye's work constitutes a truly constructive reflection which proposes, after a careful examination of the merits and demerits of constitutional justice in Senegal, "to innovate without destroying everything".
It should be noted that the author received, on November 2 in Zimbabwe, the prize for the best thesis in constitutional law in French in the competition organized by the CJCA.
